Welcome back to the Boston Barrister. My name is Kevin Patrick Seaver, and I’m located in Boston, Massachusetts. The difference between the criminal and civil cases is that, in the criminal case, Lindsay Clancy has a Fifth Amendment right against self-incrimination. She does not have to testify in the criminal case, but Attorney Seaver says she will have to testify in the civil case. He believes that testimony will be riveting, as he expects testimony in the Karen Read civil trials will be. Attorney Seaver believes the mental-health system has been scrutinized because of the Lindsay Clancy trial. He also discusses increased scrutiny of mothers after childbirth for signs of postpartum depression or psychosis, including possible involvement by the Massachusetts Department of Children and Families. He explains that every DCF case is separate and distinct, and each situation must be reviewed carefully to determine whether there is a risk to the baby. Attorney Seaver says District Attorney Timothy Cruz must consider what justice requires and whether another trial is the right course. The next hearing is scheduled for September 29, 2026, and Kevin Reddington has stated that he will seek another trial.
